At ASSERTUS, we understand that you might entrust your personal information and/or data during multiple scenarios that help us build a business relationship, and we value that trust. The collection and use of the personal information and data of our clients, prospective clients, and/or person with interest in our Services are guided by our corporate principles and responsible security information process.

Types of information we collect

ASSERTU’S collects certain information that might be used for any and all of the scenarios mentioned before. The information we could collect might include aspects and/or any details related to:

  • Identifying Information: Might consist of actions as to create a profile, an account, to place an order, to create a registry, to assign support and/or sales action, to initiate and/or continue a Services, “chat,” call or communication online and/or in person. For example, Name, Address (billing and shipping), Zip code, email address, Telephone number(s), Cellular phone number(s), Credit card/Banking number(s), Account number, Account details, and/or Security questions and/or answers.
  • Payment Information We collect this information to process a pre-approved monthly and/or annual payment/order of your entity and/or personal banking account/credit card. This might include validation aspects, for example, your credit card number and billing address.
  • Information You Post: We collect this information when you post in a public space or Website. For example, our Social Media Profiles, Ratings & Reviews feature.
  • Event Information: We collect this information when you sign-up and/or register for our events—for example, contact information and mailing address.
  • Demographic Information: We collect this information when you participate in a contest, sweepstake, promotion, and/or survey. For example, your age, gender, and zip code.
  • Driver’s License Information: We collect your driver’s license information to the extent permitted by applicable law. For example, authentication requirements. 
  • Device Information: We collect this information when you visit our Website and/or Services. For example, the type of device you use to access any of our platforms, your device identification number, IP address, or mobile operating system.
  • Location Information: We collect this information about your location when your device is set to provide location information. For more details, see the Use Of Information Technologies section below.
  • Commercial Information: We collect this information to manage, provide access based on your account/profile, and related to the Services agreed with ASSERTUS.  
  • Internet or other Network Activity Information: We collect this information when you visit our Website, use our mobile applications, and/or interact with our Services and other technologies, this information is either automatically collected or is customer-initiated. For example, your browsing history, search history, and additional information regarding your interactions with our Services, Platforms, or advertisements. 
  • Other Information: If you use our Website and/or Services, we may collect information about the browser you are using. We may look at what site you came from, or what site you visit when you leave us. We may look at how often you use our Services and/or if data and/or what type of information was downloaded. If you participate in our events, we may capture pictures, video footage, and/or record sessions, among other software of detection and/or validation purposes. When you visit our offices, we may capture pictures, video footage, and/or use facial recognition software for security purposes. When calling our customer service and/or sales & implementation department, we record calls for quality assurance and operational optimization purposes.

How we collect information

1. Information You Provide to Us 

  • We collect a variety of information when you create a profile, an account, place an order, request a quote, call for assistance, sign an agreement, complete a sales order, register for an event, or take advantage of other programs and/or Services online and/or in person. Information we may collect includes your name, address, zip code, email addresses, telephone number(s), credit card number(s), among others. 

2. Information We Collect Through Data Collection Technologies 

  • We collect information through several channels. For example, we may collect your Personal Information when you visit our websites, use our applications, or interact with our Services or other technologies and/or Platforms. This information is either automatically collected or is customer-initiated. For more details, see the section below Use of Information Technologies.

3. Information from Other Sources and Carrier Lines

  • We may collect or use the information made available to us through third-party platforms, online databases, and directories, or other means. Note that this information may be governed by the privacy statement of the third party.
  • We may share information or match customer data with a third-party. When shared, this information is de-identified or anonymized.
  • We may receive various types of information, including identification information, contact information, and transactional information from our affiliates, service providers, vendors, Business Associates, among other entities.
  • Some features or functionalities of the Services utilize include or provide connectivity to the services and/or interfaces of Third-Parties’, business partners, vendors, databases, educational material, industry associations, among others. The Services’ connectivity and/or interfaces with these Third-Parties may include direct or indirect interaction with other software, information, data, or other services. These Third-Parties may require certain or the Client and/or Users or Client, who utilize and/or access such features or functionalities of any and all of ASSERTUS Services, to agree, accept, comply, and be bound to additional terms and conditions related to the Third Parties’ terms and conditions. Client’s use and/or access of such Third-Parties’ features or functionalities constitute his/her/its acceptance and acknowledgment of being bound by any and all Third-Parties’ terms and conditions.
  • Use of such Third-Party and/or New Technology Companies products or services will constitute Client’s and/or Users’ agreement to be bound by the terms of those Third-Parties and/or New Technology Companies. 
  • Client and/or Users acknowledge that access to the Services will be provided over various facilities and communications lines, and information will be transmitted over local exchange and internet backbone carrier lines and through routers, switches, and other devices (collectively, “carrier lines”) owned, maintained and serviced by Third-Party’s carriers, utilities, and internet service providers, all of which are beyond Company’s control. Company assumes no liability for or relating to, the integrity, privacy, security, confidentiality, or use of any Client Information while it is transmitted on the carrier lines, or any delay, failure, interruption, interception, loss, transmission, or corruption of such Client Information attributable to transmission on the carrier lines. The use of the carrier lines is solely at the Client’s risk and is subject to all applicable local, state, national, and international laws. Company will fully comply with all transmission protocols as established by applicable law.

How we share your information

We may share your information in the following ways:

  • Internally. We may share your information within our affiliates, service providers, vendors, Business Associates, among other entities.
  • On our Platforms. For example, we may display the information you post on our Services for referral, success story and/or reviews. We may also display the information you choose to share on our Marketing profiles and/or accounts, including social media, emails, and/or communications replay, repost and/or comments.
  • Our Service Providers. We may share your information with third parties who facilitate our operations and perform services on our behalf. For example, this may include advertising and marketing vendors or any other fulfillment service providers, among others.
  • With Our Business Partners. This may include third parties that provide products and services related to our business that enhance our offering portfolio, services and/or product lines to help us serve you better. 
  • With Third Parties for Marketing Purposes. This may include campaigns, events, social media accounts, and/or promotions with third parties. These third parties may also share your information with others. These third parties may use your information for their own marketing purposes or the marketing purposes of others. This may include the delivery of internet-based advertising.
  • Any Successors to All or Part of Our Business. For example, if ASSERTUS merges with, acquires or is acquired by another business entity. This may include an asset sale, corporate reorganization, or other change of control. Note that if ASSERTUS or any of its affiliates and/or subsidiaries are sold to or otherwise acquired by a third party, all the data assets will become the property of the acquiring party. Such a party will be subject to any consent(s), opt-outs, or other customer conditions on data. A change in data ownership may or may not include a notice on the primary online sites of ASSERTUS or the affected affiliates and/or subsidiaries.
  • To comply with the law or to Protect Ourselves. This could include responding to a court order or subpoena. It could also include sharing information if a government agency or investigatory body requests. We may share information when we are investigating potential fraud. This could include fraud we think has occurred during sweepstakes or promotions. 

Our use of Information Technologies

The following section describes various types of technologies we may use when you are interacting, support and/or contacting our employees, vendors, clients, prospects, business associates and/or any person and/or entity with interest in ASSERTUS products and or services. Interactions could occur under the use, access and/or contact with any and all of our Services, online profiles, marketing channels and/or activities (including social media), and/or in-person interactions.

Optimization Services 

  • ASSERTUS may share and/or use third-party and/or own products to analyze, interpret, understand, and optimize any and all Services performances and/or enhance. These tools may run in the background of our Services analyzing usage, collecting logs and/or information, and then returning reports. However, Credit card or password data is not collected for these analytics aspects. 

Social Network & New Technology Companies

  • ASSERTUS has accounts and/or profiles with several social networks and new tech companies. These companies might have specific Interest-Based Ads programs that match people that have shown interest in ASSERTUS through our Website or other Services with their profiles (such as on Facebook) and platforms (such as Facebook and Google properties). We could use this matching to deliver relevant, interest-based ads on those companies’ networks.

Mobile Applications 

  • ASSERTUS could offer mobile applications that you may download from your phone or smart device’s “app store” as well as apps that you can download from your Internet-connected devices (e.g., a smart television).
  • ASSERTUS mobile applications, with your permission, may use your device’s camera, microphone, or location information to enable features or services.
  • Assertus mobile application preferences could be managed through the ASSERTUS mobile application and your device’s settings.

3. Email Communications

Promotional or Marketing Emails: To opt-out of receiving promotional or marketing emails from ASSERTUS at a specific email address, you may:

  • Use the unsubscribe link in the footer of any email sent by ASSERTUS (if exist and/or available) 
  • In some Services, you may be able to Unsubscribe by signing into your account and/or profile and indicating your opt-out preference.

Survey Emails: We may separately send surveys, via email, to our customers in order to collect opinions and feedback about their Services experiences. To opt-out of receiving survey emails from ASSERTUS, you may use the options mentioned before and/or could use the unsubscribe link that may include the survey emails.

Note on Opting-Out of Direct Mail: Because direct mailings are often prepared well in advance (weeks, in some cases), you may, for a period of time, continue to receive some physical mail and/or email after you send us your request.

Ownership of customer data

If ASSERTUS or any of its subsidiaries are sold to or otherwise acquired by a third party, all ASSERTUS data assets will become the property of the acquiring party. Such a party will be subject to any consent(s), opt-outs, or other customer conditions on data. A change in data ownership may or may not include a notice on the primary online sites of ASSERTUS or the affected subsidiary sites and/or Services.

Safeguarding information

ASSERTUS has put in place various procedural, technical, and administrative measures to safeguard the information we collect and use. We designed our technology-enabled Services to accept, initiate, and permit communication through a Transaction Secure Layer (TSL). TSL is an encryption standard that provides a layer of security while information is being transmitted over the Internet.

As a matter of policy, we do not disclose details regarding our security measures as this could be beneficial information to criminals and other harsh actors.

Be advised, no security safeguards or standards are guaranteed to provide 100% security. You should always use appropriate self-protection measures and practice safe browsing on all websites and/or services. The National Cybersecurity Alliance provides comprehensive information to Stay Safe Online.

Additionally, sometimes harsh actors attempt to use our brand to create false representations of our Services, including sending false emails and/or conduct other illegal activities with the objective of committing fraud or attempt to breach clients and/or user’s security. We actively monitor these illegal scams and shams. If you receive any communication with the alleged ASSERTUS brand and/or related to any of our Services that seems suspicious, please contact us as soon as possible to compliance@assertus.com and/or call our Customer Service Department at 787.622.2202.

Additional Disclosures

1. Health Information

  • Some of the ASSERTUS Services may be covered by federal and/or state regulations, including HIPAA. 
  • Some of the ASSERTUS Services may include the collection of personal health information (PHI), for example – name, address, email address, social security number, health plan details, etc.

2. Children’s Online Privacy Protection Act

  • The Children’s Online Privacy Protection Act imposes requirements on Web sites that collect personal information about children under 13 years old (for example – name, address, email address, social security number, etc.). Our current website, marketing, and/or sales procedure do not include the collection of personal information on any person under 13 years old online. For this reason, our sweepstakes and other promotions conducted online are restricted to entrants who are at least 13 years old.
  • If this policy changes, we will revise this portion of our Notice of Privacy Practices and will comply with the requirements of the Children’s Online Privacy Protection Act. 

3. Click in I Agree

ASSERTUS reserves the right to use “Click-I Agree” through terms and conditions for access of Client or Users in their Services, Marketing, Sales, Operations and/or Administration Processes. Whenever Client or a User is required to “click-through” or otherwise accept or made subject to any online terms and conditions in accessing or using the Services, these terms and conditions are binding.

4. Feedback and ideas

Feedback and Ideas (as defined below) that Clients, Costumers, Prospects, Persons with interest in ASSERTUS Services, actual and/or future Users or Business Associates will restrict ASSERTUS lawful right to use, profit from, disclose, publish, keep secret, or otherwise exploit Feedback and Ideas, without compensating or crediting Client, Costumers, Prospects, Persons with interest in ASSERTUS Services, actual and/or future Users or Business Associates in question. (“Feedback and Ideas” refer to any suggestion, request, recommendation, or idea for improving or otherwise modifying any of Company’s Application Software, products, System or Services.)

5. Intellectual Property

ASSERTUS retains all right, title, and interest in and to any and all of its Services, including without limitation any and all graphics, documentation, user interfaces, logos, and trademarks reproduced through the Services. Clients, Costumers, Prospects, Persons with interest in ASSERTUS Services, actual and/or future Users or Business Associates recognizes that copyright and other laws protect the Application Software and Services and its components.

6. Services “As Is” and “As Available.”

EXCEPT TO THE EXTENT OTHERWISE SET FORTH IN THIS NOTICE, CLIENT ACCEPTS THE SERVICES “AS IS” AND “AS AVAILABLE.” NEITHER ASSERTUS, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, OR TRUSTEES NOR ANY OF ITS AGENTS, REPRESENTATIVES, SUPPLIERS, ADVERTISERS, PROMOTIONAL PARTNERS, OR LICENSORS MAKE ANY REPRESENTATION OR ADDITIONAL WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, OR ANY IMPLIED WARRANTY ARISING FROM ANY STATUTE, COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

7. Cross-functionality and Continuous Improvement.

ASSERTUS, at its sole option, and from time to time, could perform amendments, updates, changes, testing, and quality assurance processes for the improvement of this Notice and/or any of its Services. The availability of the Services for multiple devices does not guarantee that the same capabilities, features, or look and feel would be available across all the devices or for all types of Clients and/or users.

8. Choice of Law & Jurisdiction.

This Notice and all claims arising out of or related to this Notice, including without limitation torts claims will be governed solely by the applicable federal laws of the United States of America and state laws of the Commonwealth of Puerto Rico.

9.Amendement, Changes, Removal, Expansion, Updates, and Consent

ASSERTUS may amend this Notice from time to time by posting an amended version at its Website or sending Client written notice thereof. Such an amendment will be deemed accepted and become effective ten (10) days after such notice. Client’s continued use of the Services following the effective date of an amendment will confirm the Client’s consent thereto.

Client and/or User access, click, use, misuse, of any and all ASSERTUS Services and/or Platforms constitute a content to the terms and conditions of this Notice in addition to any terms and conditions of any other Third-Party and/or an actual and affective Agreements ASSERTUS.
